*Again last year, Chief Justice Higgins sentenced Darren Lee Cassidy to 15 years imprisonment with a non-parole period of 10 years and two months for the manslaughter of four-year-old Trinaty Howarth.
During the trial it was alleged Cassidy hit Trinaty - his girlfriend's daughter - on the head a number of times with a saucepan before hitting her on her stomach and legs with a walking stick.
Trinaty died two days later. The pathologist who conducted Trinaty's post-mortem examination likened her injuries to those one would receive when being hit by a car and said they were among the worst he had seen.*
THE ACT's number plate slogan is boring: "Heart of the Nation."
Let's replace it with something a little zestier: "Getting Away With Murder." Australia's national capital has not recorded one murder conviction in 11 years.
It's not that Canberra is violence-free - since 1998 a number of unfortunates have been bashed and knifed to death.
But time and again killers have been let off with manslaughter convictions and, compared with NSW, woefully inadequate sentences.
It's not the judges being soft but the constraints within the ACT's murder law definition that prevent them from finding criminals guilty of this most violent crime.
In NSW in 2004, Sef Gonzales was convicted and sentenced to life imprisonment for the murder of his mum, dad and sister. In another high-profile case, Katherine Mary Knight was sentenced to life imprisonment without parole for the murder of her de-facto husband, who she stabbed 37 times.
By comparison, in the ACT last year Glen Malcolm Porritt was found not guilty of murder but guilty of the manslaughter of his mother Nanette Porritt, who suffered 57 stab wounds. Porritt was sentenced to just five years imprisonment. He only did twenty two months in total.
Chief Justice Higgins, who presided, said: "I observe that, for this territory, intent to cause, or reckless infliction of, grievous bodily harm is insufficient for murder."
In sentencing, Chief Justice Higgins stated: "Some cases of manslaughter in this territory might well be murder in NSW."
Now families, victims' groups and police have had enough.
Finally, the ACT Government has proposed changes that would make it easier for judges to convict for murder.
This would bring the ACT into line with NSW and, families hope, would result in tougher sentences. The new laws are not exactly the same as NSW, softly softly!
"It is ridiculous that someone can commit murder in Queanbeyan [southern NSW] and the same type of crime would be treated 10 minutes away in Canberra as manslaughter on the same facts before the court," Australian Federal Police Association president Jon Hunt-Sharman said.
Johanna Wilson said the ACT's "soft" laws compounded her grief after her brother, 30-year-old Andrew Campbell, died after falling 7m from a bus overpass. John Jaques was found guilty of Campbell's manslaughter and was imprisoned for nine months.
"Can this really be justice? How can the judicial system, as it stands today, set appropriate sentences?" she asked.
A fair question, which the ACT Government has the power to address and which it should, sooner rather than later.
